End User License Agreement (EULA)
- Introduction. This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Westnet, LLC ("Westnet") regarding the use of the software application ("Software"). By installing or using the Software, you agree to abide by the terms of this Agreement. The Software is designed to deliver real-time incident alerts and call information to assist firefighters and medical responders in improving situational awareness, accelerating decision-making, and staging more effectively before arriving at the scene. Additionally, your use of the Software is subject to Westnet’s Privacy Policy, which governs the collection, use, and storage of personal data.
- License Grant. Westnet grants User a non-exclusive, non-transferable license to use the Software solely for business or agency purposes, subject to the terms of this Agreement.
- Restrictions. User shall not:
- Sell or otherwise commercially exploit the Software
- Modify, distribute, or create derivative works based on the Software
- Reverse-engineer, decompile, or attempt to extract the source code
- Use the Software for illegal or unauthorized purposes.
- Ownership. The Software is owned and copyrighted by Westnet. This Agreement does not transfer any ownership rights to User.
- Updates & Support. Westnet may provide updates to the Software, which are subject to this Agreement. Support services are provided at Westnet’s discretion and may depend on your organization’s agreement with Westnet.
- Geolocation Data. To enhance emergency response coordination, the Software may request access to your device’s geolocation. If enabled, your location data may be transmitted to your emergency response agency to assist in determining your position and estimated time of arrival relative to the incident location. This data is used solely for operational awareness and is handled in accordance with applicable privacy and data protection laws, and Westnet’s Privacy Policy. Westnet does not share your location data with third parties except as necessary for service functionality or as required by law.
- Messaging and Communication Features. The Software may include messaging or chat features for coordination among responders or agency personnel. You agree not to use these features to transmit unlawful, abusive, defamatory, or inappropriate content. Westnet is not responsible for content shared by Users and reserves the right to restrict or disable messaging functionality in the event of misuse. Message content may be retained or accessed by authorized agency administrators as part of routine operations.
- Termination. This Agreement is effective until terminated. Westnet may terminate the Agreement if User breaches any terms. Upon termination, User must cease using the Software and delete all copies.
- Warranty Disclaimer. The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. Westnet disclaims any warranties regarding performance, reliability, or fitness for a particular purpose.
- Limitation of Liability. Westnet is not liable for any indirect, incidental, or consequential damages arising from the use of the Software.
- Governing Law. This Agreement shall be governed by the laws of the State of Delaware. Any disputes arising from this Agreement shall be resolved in the courts of the State of Delaware.

- Additional Terms for Apple App Store Users. If you downloaded the Software from the Apple App Store, the following terms apply in addition to the terms above:
13.1 Acknowledgement. This Agreement is between you and Westnet only, not Apple. Westnet is solely responsible for the Software and its content.
13.2 Maintenance and Support. Westnet is solely responsible for providing maintenance and support for the Software. Apple has no obligation to provide any maintenance or support.
13.3 Product Claims. Westnet is responsible for addressing any claims by you or any third party relating to the Software or your possession and/or use of the Software, including but not limited to:
(i) product liability claims;
(ii) any claim that the Software fails to conform to any applicable legal or regulatory requirement; and
(iii) claims arising under consumer protection or similar laws.
13.4 Third-Party Beneficiary. You and Westnet acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
